Need some help...
«
on:
May 28, 2009, 11:29:31 AM »
We have allegations that a ball from our range has broken a window on the neighboring apartment complex. In order to investigate, I will be finding out the distance, angle, and height the ball will have taken to reach the broken glass. Any one know of a free program online that can give me the flight path necessary if I enter the stats?
Thanks
Loomis

I can't remember the name of it...but I think Kenny Lawson has a link to a program that sort of does that on the AOG home page.

Let me start by stating that I am not an attorney and or want to be.
I have a friend who owns a range in IL who has apartment complex running next to range as you do. I asked him a few years ago about liability and balls hitting people and or property. He stated that the range is not liable, it falls into the hands of the person hitting the ball. Therefor the owner of the building has to prove who hit the ball and so on. There is a big sign as you approach the hitting area that reads something along the line of "Hitters are responsible....". He has went round and round with the building owner and has never paid a dime over 10+ years.

Thanks for the input, EZ...Only problem is, It is a private club, it is member-owned. I don't know the details, but I am sure there are some differences when liability is concerned.
I have done some research about the timing of the incident, but haven't received all the answers...Unfortunately, the program doesn't work...I need to be able to reverse-engineer the shot...I have the distance parameters...this particvular program asks for ball speed and the like.

Pathetic. Pay for the window. If the Rylands V Fletcher rule of law does not apply in the country where the incident took place then it ought to.
People need to face up to their responsibilities in life.

good lord!....people know they are taking that chance when they live next to a range.as far as the mindless law jargon goes....you know what you can do.its like parking in the outfield at a baseball game.if a 10 year old hits your car with a homerun do you make his family pay for it?....no.its the same thing.its the stupid a$$ lawyers & politicians that have us in the situation we are in now.i wouldn't worry about it.if the people wanna yack about getting hit don't live next to a driving range smartguy.

I work at a private club and there is a house OB off the right side of #1 fairway, basically right in the wheel house of any mid level player. Now the course has been there for over 100 years and the house has not. But as stated above the course is not responsible, the golfer is. Anytime that guy calls the shop saying someone hit his house, about 3 times a week, we tell him we cant do anything unless he tells us who it was.

Many years ago, while golfing at Foothills Golf Club in Ahwatukee, AZ, I shanked one out of the rough that went straight right and into a double paned, insulated, tinted 6 ft window of a house. My roomate yelled, RUN!!, but I was busted. The lady asked whose ball was it that she was holding and my roomate immediately said, "It's his!" Ended up, my renters insurance (I was living in an apartment at the time) covered it and talking to my agent now, home owners will cover it. This, of course, is the responsibility of the golfer. I still don't understand how the homeowner isn't responsible. It's still their decision to live near a golf course or driving range.
